{"id":1071,"date":"2023-06-07T08:02:46","date_gmt":"2023-06-07T08:02:46","guid":{"rendered":"https:\/\/arrow.org.my\/saige\/?p=1071"},"modified":"2023-06-26T08:07:52","modified_gmt":"2023-06-26T08:07:52","slug":"anti-abortion-movement-in-india-realities-and-counter-mechanisms","status":"publish","type":"post","link":"https:\/\/arrow.org.my\/saige\/anti-abortion-movement-in-india-realities-and-counter-mechanisms\/","title":{"rendered":"Anti-Abortion Movement in India: Realities and Counter Mechanisms"},"content":{"rendered":"<p><strong>This blogpost was written by Alka Barua, Souvik Pyne and Vinitha Jayaprakasan from CommonHealth, India.<\/strong><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">In August 2022, on the 51<\/span><span style=\"font-weight: 400;\">st<\/span><span style=\"font-weight: 400;\"> anniversary of the Medical Termination of Pregnancy (MTP) Act that legally permits abortion under specific conditions in India, a \u2018March for Life\u2019 was organised in the national capital in memory of the millions of aborted foetuses across the world. This was followed by two other organised marches in Maharashtra, observation of Day for unborn child (25<\/span><span style=\"font-weight: 400;\">th<\/span><span style=\"font-weight: 400;\"> May) and announcements of many to come, including the \u2018March for Life\u2019 being an annual event. On the other hand, over the years, the rise in conservatism in the country has historically contributed to curbing sexual and reproductive rights, especially of religious, caste and gender minority groups.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Objections to abortion were not new for the country. Decline in population of a specific religious group in a Southern state had<\/span><span style=\"font-weight: 400;\"> set the ball rolling way back in 2007. However, the movement was not as aggressive and did not manifest in the public domain because of India\u2019s socio-cultural and legal complexities. The over<\/span><span style=\"font-weight: 400;\">ruling of\u00a0<\/span><i><span style=\"font-weight: 400;\">Roe<\/span><\/i><span style=\"font-weight: 400;\">\u00a0<\/span><i><span style=\"font-weight: 400;\">v Wade<\/span><\/i><span style=\"font-weight: 400;\">\u00a0judgment in June 2022 by Supreme Court of the USA on the grounds that abortion is not a right gave a <\/span><span style=\"font-weight: 400;\">fillip to the anti-choice movement globally. India was no exception. <\/span><span style=\"font-weight: 400;\">The landmark ruling of India\u2019s Supreme <\/span><span style=\"font-weight: 400;\">Court in September 2022 that recognised <\/span><span style=\"font-weight: 400;\">marital rape, talked about all women\u2019s autonomy to freely exercise their reproductive rights, and the entitlement of <\/span><span style=\"font-weight: 400;\">unmarried women in a consensual relationship to safe and legal abortions further aggravated those opposed to abortion. Both these happenings spurred the <\/span><span style=\"font-weight: 400;\">anti-choice entities to intensify their efforts. <\/span><span style=\"font-weight: 400;\">They<\/span> <span style=\"font-weight: 400;\">hoped that their efforts would inspire others to protest against access to abortion and succeed in revoking the MTP Act.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The anti-choice entities<\/span> <span style=\"font-weight: 400;\">are trying to<\/span><span style=\"font-weight: 400;\"> mobilise youth groups and bring together like-minded entities to organise public rallies, perspective building workshops, file public interest litigations, influence health system functionaries and amplify their visibility via media channels to create an anti-abortion discourse.<\/span><\/p>\n<h6 style=\"text-align: center;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-1073 aligncenter\" src=\"https:\/\/arrow.org.my\/saige\/wp-content\/uploads\/2023\/06\/march-for-life-300x169.jpg\" alt=\"\" width=\"300\" height=\"169\" \/><br \/>\n<em>A visual from the March for Life in New Delhi\u00a0<\/em><\/h6>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">These <\/span><span style=\"font-weight: 400;\">anti-choice entities<\/span> <span style=\"font-weight: 400;\">cleverly misinterpret data and legal and constitutional provisions, use powerful emotive imagery, <\/span><span style=\"font-weight: 400;\">borrow arguments and justifications from other movements and <\/span><span style=\"font-weight: 400;\">co-opt the anti-sex selection agenda and disability groups <\/span><span style=\"font-weight: 400;\">to bolster their case<\/span><span style=\"font-weight: 400;\">. <\/span><span style=\"color: #333333; text-align: center;\">\u00a0 \u00a0<\/span><\/p>\n<h6 style=\"text-align: center;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-1072 aligncenter\" src=\"https:\/\/arrow.org.my\/saige\/wp-content\/uploads\/2023\/06\/poster-abortion-292x300.png\" alt=\"\" width=\"292\" height=\"300\" \/><br \/>\n<em>A social media poster<\/em><\/h6>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">In India, <\/span><span style=\"font-weight: 400;\">t<\/span><span style=\"font-weight: 400;\">he feminist movement has historically not been engaged in advocating for reproductive rights and choices in the context of abortion and there are multiple opportunities to foster the movement and misinterpret policies and legal stipulations. Government\u2019s aggressive and misdirected public campaigning against<\/span> <span style=\"font-weight: 400;\">sex determination has focused<\/span> <span style=\"font-weight: 400;\">on induced abortions for gender-biased sex selective reasons <\/span><span style=\"font-weight: 400;\">instead of addressing the innate societal son-preference. <\/span><span style=\"font-weight: 400;\">In the course of discussions on the MTP (Amendment) Bill, 2020 in the parliament, even public representatives referred to \u2018abortion as murder\u2019<\/span><span style=\"font-weight: 400;\">.<\/span><span style=\"font-weight: 400;\"> All this has led to further stigmatisation of abortion overall, generating<\/span> <span style=\"font-weight: 400;\">a public perception that abortion is illegal in the country. Apprehensions of backlash that led to discontinuation of Comprehensive Sexuality Education has stifled reliable sources of information for the young and inadequate public health infrastructure has left people in certain regions with religious institutions as the only alternative source of services. Additionally, the disproportionate liberty accorded to eugenic conditions in the MTP Act and centering a protectionist approach to the adolescent sexuality discourse rather than unequivocally foregrounding the pregnant person\u2019s request unconditionally often come in conflict with a rights-affirming narrative. Even a range of entities including large donors and philanthropies working on SRH issues exclude abortion from the discourse and inadvertently undermine<\/span><span style=\"font-weight: 400;\">\u00a0access to safe abortion. <\/span><span style=\"font-weight: 400;\">Inconsistent court judgments also cloud <\/span><span style=\"font-weight: 400;\">the environment of the rights movement<\/span><span style=\"font-weight: 400;\"> and embolden those against the right to safe abortion.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">CommonHealth, a coalition that advocates for reproductive rights especially right to safe abortion of marginalised population, in the course of its work, realised that it is necessary to map and counter the anti-choice movement and the support it gets. It organised a panel discussion on anti-choice movement and opposition to sexual and reproductive rights both within and outside the country.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Discussions highlighted the potential approaches to counter such movements. Learning from countering opposition to LGBTQI rights in India has been that the battle has to be socio-legal with strong emotional value, fought on the terrain of the opposition and has to be rooted in the <\/span><span style=\"font-weight: 400;\">values enshrined in the country\u2019s constitution. The legal battle has to be equipped with scientific and legal references including comparative jurisprudence from other countries. Experience in other regional countries has shown that opposition is not homogeneous and needs context specific efforts to counter it \u2013 to push back, engage or ignore. CommonHealth plans to frame its mitigation strategies based on these learnings as well as it\u2019s own experience in the field and in the context of <\/span><span style=\"font-weight: 400;\">the diversity in the opposition entities, inter-linkages amongst their approaches, assessment of their direct\/indirect role and the influence they wield in the movement.
